TORONTO _ Equifax is facing investigations in both Canada and the U.S. into its massive data breach, but lawyers say the punitive threat by regulators is stronger south of the border.
Canada’s privacy commissioner said Friday that it started a probe into the cyberattack, one day after the U.S. consumer watchdog said it was investigating.
A Toronto cybersecurity and privacy lawyer says that if the credit monitoring company is found to have failed to do enough to protect consumers’ data, the Federal Trade Commission in the U.S. can issue hefty fines.
Lyndsey Wasser says that Canada’s privacy watchdog cannot hand down fines but can recommend the company make changes and sign an agreement urging them to comply.
Ottawa lawyer Tamir Israel points to the hacking of Canadian affair-seeking website Ashley Madison, which paid $1.6 million US to settle with the FTC but was not fined in Canada.

TORONTO — Equifax Inc. says it intends to provide an update this week to Canadians on the impact of the massive data breach it recently suffered, but would not say how many individuals north of the border may have had their personal information compromised.

The credit data company told The Canadian Press that this update will include how Equifax intends to notify any potentially impacted individuals.
Canada’s privacy commissioner said Friday that it started a probe into the cyberattack and Equifax has committed to contacting Canadians whose data may be at risk in writing as soon as possible.
Equifax said on Sept. 7 that it fell victim to a massive cyberattack in the summer that may have compromised the personal data of 143 million Americans and an undisclosed number of Canadian and U.K. residents.

A new international banking report groups Canada with China and the special administrative region of Hong Kong as jurisdictions whose domestic banking systems are at risk from rising debt levels.
The Bank For International Settlements, which is owned by the world’s central banks, says there are early warning indicators in credit-to-gross-domestic-product ratios which signal “vulnerabilities” in the three systems.
For Canada and Hong Kong, the stresses to the system are linked to property price gaps above critical thresholds, a measure often linked to overheated housing markets.
The bank’s second quarter report says Canada’s credit-to-GDP gap stands at 11 per cent above its long-term trend while Hong Kong is 35 per cent higher and China is up 22 per cent. The gap in the United States fell by 7.6 per cent.
The bank cautions that the numbers are “broadly indicative” of the exposure of debt service to higher yields under stress scenarios and should not be treated as a formal stress test…
