NEW YORK, N.Y. – J.C. Penney’s largest investor and former board member, William Ackman of Pershing Square Capital Management, is selling his nearly 18 per cent stake in the company.
The move to sell 39.1 million shares of the company, announced in a regulatory filing late Monday afternoon, comes two weeks after Ackman resigned from J.C. Penney’s board as part of a deal to resolve an unusually public battle between the activist investor and the struggling department store operator.
The news sent its shares down nearly 3 per cent to $13 per share in after hours-trading after closing down 15 cents to $13.35 in the regular session.
The latest development comes as the beleaguered chain is trying to recover from a botched transformation plan spearheaded by its former CEO Ron Johnson that led to disastrous financial results. The board ousted Johnson in April after only 17 months on the job and rehired Mike Ullman who had been CEO of the retailer from 2004 to 20011.

NEW YORK, N.Y. – The stock market is closing slightly lower after Secretary of State John Kerry ratcheted up pressure against Syria.
The Dow Jones industrial fell 64 points, or 0.4 per cent, to 14,946 Monday.
The Standard & Poor’s 500 index fell six points, or 0.4 per cent, to 1,656. The Nasdaq composite was down a fraction of a point at 3,657.
Stocks sagged in the last hour of trading after Kerry stepped up criticism of Syria, calling last week’s attack a “moral obscenity.”
Stocks started the day higher after a handful of corporate deals were announced.
Amgen surged after the biotech giant said it plans to buy Onyx Pharmaceuticals for $10.4 billion.
Three stocks fell for every two that rose on the New York Stock Exchange. Volume was very low at 2.4 billion shares.

NEW YORK, N.Y. – JPMorgan has been ordered to pay billionaire Leonard Blavatknik $42.5 million damages in relation to a soured investment in mortgage-backed securities.
Blavatnik, who ranks 44th on Forbes list of billionaires, had sought to recover more than $100 million due to JPMorgan’s “alleged mismanagement” of his funds during the early stage of the housing crisis of 2007.
In a decision made public on Monday after a three-week trial, New York State Supreme Court Justice Melvin Schweitzer ruled that JPMorgan had breached its contract with Blavatnik’s CMMF fund because it exceeded a 20 per cent cap for mortgage-backed securities in the fund.
Blavatnik had also argued that JPMorgan had been negligent in its management of the fund. However, Schweitzer said that the bank had acted “reasonably, in light of the information that was available to it at the time.”
The ruling was dated August 21.
